Terms and Conditions
Effective date: 29 September 2026
1.Acceptance of Terms
- These general terms and conditions (the “Terms”) govern your access to and use of the services related to the application capria (the “Application”).
- If you do not agree with all or part of these Terms, you may not access or use the Application. Your consent to the Terms in its entirety is a mandatory prerequisite for accessing and using the Application.
- The term “we” or “us” refers to capria which is a sole proprietorship registered with the Dutch Chamber of Commerce under the registration number 42083324.
- The term “you” refers to the user of the Application.
- We are the developer and offeror of the Application. For any questions regarding these Terms, please contact us at [email protected].
2.The Application
- The Application is a productivity software which allows users to organise, track and achieve goals.
- The Application can be downloaded and used on mobile devices on the iOS operating system.
3.Eligibility
- You must be at least 18 years old to use the Application.
- By agreeing to these Terms, you represent and warrant to us that:
- you are at least 18 years old;
- you have not previously been suspended or removed from the Application; and
- your registration and use of the Application is in compliance with any and all applicable laws and regulations.
- If you are an entity, organization, or company (“Company”), the individual accepting these Terms on your behalf represents and warrants that the individual has the authority to bind you to these Terms and you agree to be bound by these Terms.
4.Account creation and registration
- You can start using the Application without an account. Some features, including buddies and accountability partners, require an account.
- You can create an account with Sign in with Apple or with an email address.
- When you register for an account, you may be required to provide us with some personal information, such as your name, email address, or other contact details.
- You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times.
- If you register with an email address, you will be asked to choose a password. You are responsible for keeping your login details confidential, and you accept responsibility for all activities that occur under your account. If you believe that your account is no longer secure, then you must immediately notify us by contacting customer service at [email protected].
5.Subscription and payments
- Some features of the Application require a paid subscription (the “Subscription Service”). Before you are charged, you will always see the price and can review and accept it first. All prices are shown in the Application in the currency of your App Store account.
- All purchases are made through your App Store account and processed by Apple. Apple’s terms and payment methods apply to the payment, and any refund requests are handled by Apple under its policies.
- We may change the price of the Subscription Service. If we do, you will be informed in advance through the App Store before the new price applies, and you can cancel before it does. We may also offer promotions with different features or prices. Unless such an offer is made to you, it does not apply to your subscription.
- The Subscription Service renews automatically at the end of each period (monthly or yearly, as chosen at purchase) until you cancel it. The Subscription Service may include a free trial; unless you cancel before the trial ends, the subscription starts and you are charged at the end of the trial.
- You can cancel at any time in your App Store account settings. To avoid being charged for the next period, you must cancel at least 24 hours before your subscription renews. Cancelling stops future renewals; you keep access to the paid features until the end of the current period.
6.capria Service Products
- You may choose to sign up for the free version of the Application (“capria Freemium”) or the Subscription Service, which automatically renews at the end of your billing period consistent with the terms of Article 5 (Subscription and payments).
- You can upgrade from capria Freemium to the Subscription Service at any time from within the Application.
7.Ownership and proprietary rights
- capria owns and operates the Application. All materials and elements of the Application that we provide, including its visual interfaces, graphics, design, compilation, information, data, computer code (including source code and object code), products, software, services and promotional content (“Materials”) are protected by intellectual property and other laws.
- The Materials are the property of capria. You may not use the Materials unless we expressly allow it. We reserve all rights to the Materials that are not expressly granted to you in these Terms.
8.Communications
- When you install the Application on your mobile device, you may choose to receive push notification. These are messages an app sends you on your mobile device when the Application is not on. You can turn notifications on or off by visiting your device’s “settings” page.
- We may send you emails about the Application and your account. We only send you promotional emails with your consent, and you can withdraw that consent at any time by following the unsubscribe instructions in the email.
9.Prohibited Conduct
- By using the Application you agree not to:
- use the Application for any illegal purpose or in any way that is in violation of applicable law;
- harass, threaten, demean, embarrass, or otherwise harm anyone else;
- violate, or encourage others to violate, the rights of others, including by infringing their intellectual property or by using or sharing someone else’s confidential information without permission;
- interfere with the Application’s security features, for example by: (i) disabling or bypassing features that prevent or limit the use or copying of content, including any controls or restrictions set by administrators; or (ii) reverse engineering or otherwise trying to discover the source code of any part of the Application, except where applicable law expressly allows it;
- disrupt how the Application works or other users’ enjoyment of it, for example by: (i) uploading or spreading any virus, adware, spyware, worm, or other harmful code; (ii) sending unsolicited offers or advertisements to other users; (iii) collecting personal information about another user without their consent; or (iv) interfering with any network, equipment, or server used to provide the Application;
- sell or transfer the access granted to you under these Terms, or any Materials, or any right or ability to view, access, or use the Materials; or
- attempt any of the acts described in this Article, or help or allow anyone else to do so.
10.Buddies and accountability partners
- You can invite another user to take on a challenge with you as a buddy, or to support you as an accountability partner. A connection only starts when the other user accepts your invitation.
- A buddy sees your name, the challenge you share, your progress and your check-offs for that challenge. An accountability partner sees your name, the goal you share with them, your progress, your weekly check-in answers and the reactions you exchange. Neither sees your other goals, plans or reflections.
- Users interact in the Application only through fixed reactions and choices. The Application does not allow free text, photos or messages between users.
- We have zero tolerance for objectionable content and abusive users. This includes offensive, hateful or sexual display names, and using these features to harass, threaten or pressure anyone.
- You can end a connection, block a user or report a user at any time from within the Application. Blocking ends the connection and prevents new invitations from that user.
- We review every report within 24 hours. If a user breaches this Article or Article 9 (Prohibited Conduct), we remove the objectionable content and may suspend or terminate that user’s account.
11.Modification of these Terms
- We reserve the right to change these Terms at any time. Please check these Terms from time to time for updates.
- If a change to these Terms significantly affects your rights or obligations, we may ask you to accept the updated Terms before you can continue using the Application.
- Significant changes take effect once you accept the updated Terms. Minor changes take effect as soon as we publish them.
- We will notify you of any significant change to these Terms through one of the following:
- an email;
- an in-app notification; or
- a notice on our website.
12.Term and termination
- These Terms are effective beginning when you accept the Terms or first download, install, access, or use the Application and ending when terminated as described in Article 12.2.
- If you breach these Terms, we may suspend or terminate your account and your access to the Application, with immediate effect where the breach justifies it. We may also end these Terms for other reasons by giving you at least 30 days’ notice. You can terminate these Terms at any time by deleting your account in the Application (Settings) or by contacting us at [email protected]. Deleting your account also ends your connections with buddies and accountability partners.
- If you request access to an account, or request information about an account, we may ask you for any verification we consider necessary before we restore that access or share that information.
13.Modification of the Application
- capria reserves the right to modify or discontinue the Application at any time (including by limiting or discontinuing certain features of the Application), temporarily or permanently, without notice to you. capria will have no liability for any change to the Application or any suspension or termination of your access to or use of the Application.
14.Indemnity
- To the fullest extent permitted by law, you are responsible for how you use the Application. You agree to defend and indemnify capria and its officers, directors, employees, consultants, affiliates, subsidiaries and agents (together, the “Related Persons”) against any claim brought by a third party, and against any related liability, damage, loss, or expense (including reasonable legal fees and costs), that arises out of or relates to:
- your unauthorised use or misuse of the Application;
- your violation of any part of these Terms, or of any applicable law or regulation;
- your violation of any third-party right, including any intellectual property, publicity, confidentiality, property, or privacy right;
- the nature or content of data processed through the Application;
- your use of the Application in breach of your obligations under any agreement between you and a third party, including your duty to maintain and protect that party’s confidential information and trade secrets; or
- any dispute or issue between you and a third party.
- We reserve the right, at our own expense, to take over the exclusive defence and control of any matter that would otherwise be subject to indemnification by you. This does not reduce your indemnification obligations for that matter, and you agree to cooperate with our defence of those claims.
15.Disclaimers
- The Application, and all Materials available through it, are provided on an “as is” and “as available” basis.
- To the fullest extent permitted by law, capria gives no warranties relating to the Application or the Materials other than those stated in these Terms or required by applicable law.
- capria does not warrant that the Application, or any part of it, or any Materials offered through or processed by it, will be uninterrupted, secure, or free of errors, viruses, or other harmful components, and capria does not warrant that any of these issues will be corrected.
- No advice or information, whether oral or written, that you obtain from the Application, from capria, or from any Materials, creates any warranty regarding capria or the Application that is not expressly stated in these Terms.
- You understand and agree that you use the Application at your own discretion and risk, and that capria is not responsible for any damage to your property (including any computer system or mobile device you use in connection with the Application) or for any loss, use or disclosure of your data, including your content.
- The limitations, exclusions and disclaimers in this Article apply to the fullest extent permitted by law. capria does not disclaim any warranty or other right that it is prohibited from disclaiming under applicable laws.

- To the fullest extent permitted by law, the Related Persons (as defined in Article 14.1 (Indemnity)) will not be liable to you for any indirect, incidental, special or consequential damages, or for any loss of profits, goodwill, data, or other intangible loss, arising out of or relating to your access to or use of, or your inability to access or use, the Application or any Materials, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not capria has been informed of the possibility of such damage. In particular, capria is not responsible for any service interruption or loss of data, or for the personal or professional results you do or do not achieve through the Application, or for any action you take based on the content, prompts, scores, or recommendations provided by the Application.
- To the fullest extent permitted by law, the total aggregate liability of the Related Persons for all claims arising out of or relating to the Application or these Terms, whether in contract, tort, or otherwise, is limited to the greater of (i) the amount you paid to capria for the Application in the 12 months before the event giving rise to the claim; or (ii) 100 euro.
- Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence and for any rights you have as a consumer that cannot be excluded or limited under applicable law.
17.User data and privacy

You hereby represent and warrant that:
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and
- you are not listed on any U.S. Government list of prohibited or restricted parties.
19.Severability
- If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the smallest extent necessary, and the rest of the Terms will remain in full force and effect.
